INFORMATION ON SUBMISSION OF REQUESTS FOR THE EXERCISE OF THE DATA SUBJECT'S RIGHTS

 

In accordance with the Personal Data Protection Act (PDPA), the data subject shall have the right, when his or her personal data are processed by the Ministry of Interior (MoI) for the purposes of the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to the public order and security, to obtain from the Minister of Interior:

  1. Confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data (Article 55 of the PDPA);

  2. Rectification of inaccurate personal data relating to him or her or completion of incomplete personal data (Article 56 (1) of the PDPA);

  3. Erasure of personal data concerning him or her where processing infringes the provisions of Art. 45, 49 or 51 of the PDPA or where personal data must be erased in order to comply with a legal obligation to which the controller is subject (Article 56 (2) of the PDPA);

  4. Restriction of processing where the accuracy of the personal data is contested by the data subject and their accuracy or inaccuracy cannot be ascertained or the personal data must be maintained for the purposes of evidence (Article 56 (4) of the PDPA).

The data subjects exercise the above mentioned rights, as well as the rights under Articles 15 - 22 of the Regulation (EU) 2016/679, by submitting a written request to the Minister of Interior.

The request can be submitted in one of the following ways:

  1. In paper form by mail or in person at all organisational units of MoI (general directorates, regional directorates, directorates, etc.) on the territory of the Republic of Bulgaria;

  2. In an electronic form using the e-mail address of the respective organisational unit of MoI. In this case the request has to be signed with a qualified electronic signature;

  3. By the Secure Electronic Service System, maintained by the State e-Government Agency.

Requests have to be submitted to the organisational unit of MoI (general directorate, regional directorate, directorate, etc.), which recorded or which has initiated the recording of the personal data you are interested in in the MoI filing systems. If you are not sure which is the respective organisational unit or in the case of personal data recorded in the MoI filing systems by two or more organisational units of MoI, you can submit your request to the General Directorate National Police, 1 Alexander Malinov Boulevard, 1715 Sofia, Bulgaria, e-mail address: [email protected].

Where there are reasonable doubts concerning the identity of the natural person making a request, the respective organisational unit of MoI may request the provision of additional information necessary to confirm the identity of the data subject.  

When submitting the request by an authorized representative the proxy has to be attached to the request.

The above rules do not apply to:

  1. Procedures relating to access to public information within the meaning of the Access to Public Information Act;

  2. Erasure of a police record under Article 68 (6) of the Law on the Ministry of Interior, which is carried out in accordance with Section III of the Ordinance on the procedure for creating and erasure of police records;

  3. Provision of information or documents certifying the availability of data in the MoI filing systems when this is subject to a special procedure according to the applicable legislation or to payment of a fee in accordance with the Tariff № 4 on the fees collected in the system of the Ministry of Interior under the State Fees Act.
