Permit for Transportation of Explosive Materials in EU

1159 Issuance of permits for transportation of pyrotechnic articles and explosives, with the exception of explosives for civil use, from the territory of the Republic of Bulgaria to another Member State by natural and legal persons registered as traders and by non-profit legal entities

Authority issuing an individual administrative act:

The director of General Directorate National Police or an official authorized by him/her, or the head of the LPS of MoI.

Reception of documents:

Issuing procedure and necessary documents:

Permits for transportation of pyrotechnic articles and explosives, except for civil purposes, from the territory of the Republic of Bulgaria to another Member State shall be issued to natural and legal persons registered as traders, non-profit legal entities registered under the national legislation of a country and by entities created by law or by an act of the Council of Ministers, which beforehand have been granted a permit for production, trade, acquisition and/or storage.

 

In order to obtain a transport permit, the persons shall submit an application form to GDNP, accompanied by the following documents:

1. Copy of a contract with a person performing private security activity;

2. Certificate of suitability of the vehicle, if required, in accordance with the requirements of the international agreements for transportation of dangerous goods to which the Republic of Bulgaria is a party;

3. Document for paid fee at a rate determined by a tariff.

4. Prior consent of the Member State when required under its national law.

5. When explosives and pyrotechnic articles fall within the scope of the Export Controls Act for defense related products and dual-use items and technologies, its requirements shall also be applied.

 

Upon receipt of the application and the documents, GDNP shall assess the completeness and the correspondence of the submitted documents with the requirements for issuing the permit.

 

In case of incompleteness and/or inconsistency with the requirements for authorization, GDNP shall notify the applicant in writing and give instructions and a 30-day period for their removal.

 

If the deficiencies and/or inconsistencies found are not remedied within the given time limit, the procedure for issuing the authorization shall be terminated.

 

The Director of GDNP or an official authorized by him/her shall issue a permit or reasonably refuse to issue it within one month of the filing of the application.

 

The refusal is subject to appeal under the Administrative Procedure Code.

676 Issuing of permits for transportation of pyrotechnic articles and explosives, with the exception of explosives for civil purposes, from the territory of the Republic of Bulgaria to another Member State by natural persons

 

Legal grounds:

Law on Arms, Ammunition, Explosives and Pyrotechnic Articles, art. 111, para 1 and art. 99, para 2

 

Authority issuing an individual administrative act:

Director of National Police General Directorate or authorized by him official, or head of regional MoI department.

 

Reception of documents:

Issuing procedure and necessary documents:

Permission for transportation of pyrotechnic articles and explosives, except for civil purposes, from the territory of the Republic of Bulgaria to another Member State shall be issued to natural persons holding a permit for the acquisition of explosives and pyrotechnic articles.

In order to obtain a transport authorization, the persons shall submit an application form to GDNP, accompanied by the following documents:

1. Copy of a contract with a person performing private security activity;

2. Certificate of suitability of the vehicle, if necessary, in accordance with the requirements of the international agreements for transportation of dangerous goods to which the Republic of Bulgaria is a party;

3. Document for paid fee at a rate determined by a tariff.

4. Prior consent of the Member State when required under its national law.

5. When explosives and pyrotechnic articles fall within the scope of the Export Controls Act for defense-related products and dual-use items and technologies, its requirements shall also be applied.

677 Issuing of documents for transportation of explosives for civil purposes within the European Union from the territory of another Member State to the territory of the Republic of Bulgaria by natural and legal persons registered as traders and by non-profit legal entities.

Issuing procedure and necessary documents:

Transport of explosives for civil use from the territory of another Member State to the territory of the Republic of Bulgaria shall be carried out with a document for transportation of explosives for civilian purposes within the European Union, according to Annex 2 of the Arms, Ammunition, Explosives and Pyrotechnic Articles Act, issued by the Director of the General Directorate National Police (GDNP) of the Ministry of Interior or by an official authorized by him/her.

 

The document shall be issued to a person who has been authorized to manufacture, trade, acquire and/or store explosives for civil use, hereinafter referred to as "the Recipient".

 

For the purpose of obtaining the prior consent of the Member States through which the shipment shall be transited and by the Member State of origin, the recipient shall send to the relevant competent authorities a document in accordance with the template in the Annex, containing the following information:

• Number and date of expiration of the relevant authorization of the recipient;

• Name, address, telephone number and e-mail address of the recipient, the supplier and the persons carrying out the shipment;

• Description of the mode of transport and the route of delivery and, where possible, entry and exit points in the Member States;

• Date of departure and expected date of arrival;

• Name and address of the manufacturer's management and quantity of explosives for civilian use;

• Identification number according to the UN Recommendations on the Transport of Dangerous Goods.

 

The Recipient submits to DGNP:

1. Filled in and stamped by the relevant competent authorities document or a document attesting the consent of the competent authorities of each of the Member States through which the shipment will be transited,

2. Declaration that the civilian explosives have a CE conformity marking according to the Law on Technical Requirements to Products and have been given unique identification, if they will be placed on the Bulgarian market;

3. Document of paid fee at the rate determined by a tariff;

4. Where the person has only received an acquisition permit, it shall indicate the address of the storage site for the supply.

 

After presenting the required documents, the Director of GDNP or an official authorized by him/her shall issue the transport document.

319 Issuing of documents certifying the consent of the Republic of Bulgaria for the transit or dispatch of explosives for civil purposes, for the purpose of transportation within the European Union

 

Legal grounds:

Law on Arms, Ammunition, Explosives and Pyrotechnical Articles, Art. 109

 

Authority issuing an individual administrative act:

The Director of the National Police General Directorate or authorized by him official.

 

Reception of documents:

At an administrative service desk.

 

Issuing procedure and necessary documents:

The transportation of explosives for civilian use from the territory of the Republic of Bulgaria to another Member State or from a Member State through the territory of the Republic of Bulgaria to another Member State is carried out with a document for transportation of explosives for civilian purposes within the European Union, issued by the competent authority of the host Member State.

 

The Director of the National Police General Directorate (GDNP) or an official authorized by him/her issues a document certifying the consent of the Republic of Bulgaria for transit or delivery of the shipment, or stamps the document for transportation of explosives for civilian purposes within the European Union.

 

When transporting explosives for civilian purposes from a Member State through the territory of the Republic of Bulgaria to a third country, the Director of GDNP or an official authorized by him/her issues a document certifying the consent of the Republic of Bulgaria for the transit.
