PCC SEE

Implementation Agreements

Pursuant to Art. 34, paragraph 1 of the Convention the countries may conclude bilateral agreements for its implementation. Regardless of the dispositional formulation, if there are no implementation agreements the cooperation mechanism provided for by the Convention can not be realized in practice. 

The Republic of Bulgaria has signed modern bilateral agreements on police cooperation with all the Contracting Parties of PCC SEE, as follows:

- Protocol between the Government of the Republic of Bulgaria and the Council of Ministers of Bosnia and Herzegovina Implementing the Agreement between the European Community and Bosnia and Herzegovina on the Readmission of Persons Residing without Authorisation - signed on 16 November 2011, forthcoming entry into force (the Bulgarian internal procedure was completed in January 2012);

- Protocol between the Ministry of Interior of the Republic of Bulgaria and the Ministry of Interior of the Republic of Macedonia on the Implementation of the Agreement between the European Community and Former Yugoslav Republic of Macedonia on the Readmission of Persons Residing without Authorisation - signed on 21 February 2011, forthcoming entry into force (the internal procedures of both countries were completed in December 2011)


- Protocol between the Government of the Republic of Bulgaria and the Government of Montenegro Implementing the Agreement between the European Community and the Republic of Montenegro on the Readmission of Persons Residing without Authorisation - signed on 15 November 2010, forthcoming entry into force (the internal procedures of both countries were completed in the beginning of 2011)]

 

 


 In the existing agreements there are provisions regulating some of the forms of cooperation foreseen in PCC SEE. 

  • Liaison officers – in the Agreements with Macedonia and with Romania from 2002 and in the Agreements with Serbia and Montenegro from 2010.
  • Witness Protection – explicit clause in the Agreement with Romania from 2002 and in the Agreement with Moldova. According to the Bulgarian national legislation the leading authority with regard to the witness protection is the Ministry of Justice.
  • Hot pursuit and Cross-border Surveillance – in the Agreement with Romania on Cross-Border Police Cooperation in Criminal Matters.
  • Controlled Delivery – in the Agreements with Macedonia and Serbia from 2002, in the Agreement with Bosnia and Herzegovina from 2007 and in the Agreement with Montenegro from 2010, as well as in the Trilateral Protocol between Bulgaria, Romania and Serbia from 2008. 
  • Technical Measures for Facilitating Trans-border Cooperation – This issue is subject of the Agreement on the Vardar Telephone Connection with Macedonia; there are provisions for this matter and in the agreements for Co-operation between Border Guard Bodies with Romania and with Serbia.
  • Mixed Patrols – specific agreement with Macedonia from 2011; explicit clause in the agreement on border cooperation with Romania from 2004, special chapter in the agreement on police cooperation with Serbia from 2010.
  • Cooperation in Common Centres – Bulgaria has bilateral agreements on establishment of common contact centres for police and customs cooperation with all neighbouring PCC SEE Contracting Parties (Macedonia, Romania and Serbia).
