On 11th November 2003 the National Assembly of Republic of Bulgaria adopted the Amending and Supplementing Act to the Ministry of the Interior Act (promulgated in the State Gazette, Volume 103/25.11.2003). According to the Act has provided for the establishment of the Migration Directorate within the Ministry of the Interior as a specialized unit responsible for the administrative control of residence of foreign nationals in the Republic of Bulgaria on a national level.Migration Directorate is in charge of the control of observing the order and conditions of residence of foreign nationals in the country, as well as in the issuance, rejection/denial and deprivation of long term residence permits, and also in charge of the interaction and information in the area of migration processes with other state authorities, NGO-s, etc, and for the exchange of information with all the latter. The Migration Directorate is in charge of the management, maintenance and security of specialised facilities for interim accommodation of foreign nationals who are subject to escort out of the country or expulsion. In each 28 districts where are Regional Directorates of Interior were set up the Migration Regional Units on a local level. In some of major towns, which are tourist or cultural centers or have a strategic importance there are responsible migration officers.Foreigners reside in Republic of Bulgaria for a short term and long term. The long term is:
- continuous – with a permitted period of stay of up to one year;
- permanent – with a permitted indefinite period of stay
Residence permit is for an indefinite period of time. To obtain such a permit the foreigner national should be in possession of a valid passport for traveling abroad during this period of time and could be obtained from authorities for administrative control over foreigners after the first entry in the country with a long-term visa (visa type “D”).
The authority for administrative control over foreigners is Migration Directorate within Ministry of interior. The diplomatic and consular missions of Republic of Bulgaria in the relevant countries are empowered to accept applications and documents for visa type “D”. Permits for permanent stay in Republic of Bulgaria is issued by director of Migration Directorate within Ministry of interior. Permits for long term are issued by Regional Migration Units within Regional Directorates of interior in the place of residence.
EU citizens from Schengen list have the right to sojourn on the territory of Republic of Bulgaria without visa within 90 day each 6 months. For the rest of EU countries the term is 30 days each 6 moths.
A foreigner entered on the national territory is obligated 5 days after his entry in the country to declare in writing the address of his residence before the authorities for administrative control over foreigners or before the police station in the place of residence.
Each last Tuesday of the month from 11 a.m. until 12 p.m. is Migration Directorate’s Director reception day. Every Tuesday and Thursday from 11 a.m. until 12 p.m. there is a reception hour for foreigners’ administrative attendence.
Documents and applications can be handed in every day from Monday to Friday in the desks on 48, Kn. Maria Louiza blvd. Working hours are from 08.45 a.m. until 5 p.m.
